1. About Club Golf Elevation

Club Golf Elevation is an online educational and training platform dedicated to golfers and their families.

In these Terms of Use, “MC Dynamics”, “we”, “us” or “our” refers to MC Dynamics, and “Club Golf Elevation” refers to the online platform, educational content, community, events and services made available through it.

By creating an account or purchasing a membership, you agree to these Terms of Use.

2. Membership and Account

To access Club Golf Elevation, you must create a personal account and provide accurate and up-to-date information.

Your account is personal to you. You may not share your login credentials or allow another person to access your membership.

You are responsible for keeping your login details confidential and for all activity carried out through your account.

We reserve the right to suspend or terminate an account in the event of unauthorized access, account sharing, misuse of the platform, or violation of these Terms.

3. Membership Plans and Payments

Club Golf Elevation may offer different membership plans, including monthly and annual subscriptions.

The applicable price, billing frequency and subscription conditions are displayed before purchase.

Unless otherwise stated, subscriptions renew automatically at the end of each billing period.

All prices displayed to consumers in France and the European Union include applicable VAT where required by law.

Payments are processed through the payment services available on the platform.

4. Cancellation

You may cancel your subscription in accordance with the cancellation conditions applicable to your membership plan.

Cancellation prevents future renewals but does not generally result in a refund for the current billing period, unless otherwise required by applicable law.

Where required by applicable law, you will be provided with a simple electronic means of cancelling your subscription.

5. Right of Withdrawal and Digital Content

Consumers in the European Union generally have a 14-day right of withdrawal for distance contracts, subject to applicable legal exceptions.

For digital content and digital services, where you request immediate access to the membership and its digital content before the end of the withdrawal period, you expressly acknowledge that the service may begin immediately.

Where permitted by applicable law, you acknowledge that you may lose your statutory right of withdrawal once the digital content or service has begun with your express consent.

Nothing in these Terms limits any mandatory consumer rights that cannot legally be excluded.

6. Educational Content

Club Golf Elevation provides educational and training content relating to golf, performance, practice and tournament preparation.

The content is provided for educational purposes only and is not a guarantee of sporting performance, tournament results, rankings, scholarships, recruitment outcomes or any other specific result.

Individual results may vary depending on the golfer, their level, practice, commitment, physical condition, coaching environment and many other factors.

7. Intellectual Property

All videos, courses, documents, exercises, texts, graphics, training materials, methods, recordings and other content made available through Club Golf Elevation are protected by intellectual property laws and remain the property of MC Dynamics or its respective licensors.

Your membership gives you a personal, limited, non-exclusive and non-transferable right to access and use the content for your own personal educational purposes.

You may not copy, reproduce, distribute, sell, publish, share, record, modify or commercially exploit any Club Golf Elevation content without our prior written permission.

8. Community and Events

Club Golf Elevation may include community features, live sessions, masterclasses, webinars or other events.

When participating in the community, you agree to behave respectfully and not to publish unlawful, defamatory, offensive, discriminatory or promotional content without authorization.

We reserve the right to remove inappropriate content and, where necessary, suspend or terminate access to the community.

Live sessions may be recorded for educational or replay purposes. Where applicable, participants will be informed of the recording.

9. Availability of the Platform

We aim to keep Club Golf Elevation available and operational, but we do not guarantee uninterrupted or error-free access.

The platform may occasionally be unavailable due to maintenance, technical issues, updates or circumstances outside our reasonable control.

10. Third-Party Services

Club Golf Elevation may rely on third-party services, including payment processors, hosting providers, video platforms, communication tools and other technology providers.

Your use of certain third-party services may also be subject to their own terms and privacy policies.

11. Limitation of Liability

To the maximum extent permitted by applicable law, MC Dynamics shall not be liable for indirect or consequential losses arising from the use of the platform or its educational content.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

12. Changes to the Service or These Terms

We may update the platform, its content, membership plans or these Terms from time to time.

If material changes are made, we will provide appropriate notice where required by law.

Your continued use of the platform after the effective date of updated Terms constitutes acceptance of the changes.

Your personal data is processed in accordance with our Privacy Policy.

By using Club Golf Elevation, you acknowledge that you have read the Privacy Policy.

14. Governing Law

These Terms are governed by the laws of France, subject to any mandatory consumer protection provisions applicable in your country of residence.

For consumers, nothing in these Terms prevents you from benefiting from mandatory rights or bringing proceedings before a competent court under applicable consumer protection laws.
